Kantar Acceptable Use Policy

Overview  

This Acceptable Use Policy ("AUP") applies to your use of Kantar's products, technologies, platforms, and services (the “Services”) including those that incorporate or deliver AI functionality (“AI Services”). 


Responsible Conduct  


You will not: 

 

  • Attempt to gain unauthorized access to, disable, evade, disrupt or interfere with, damage, or disrupt any parts of the Services or any connected or related computer, software, firmware, hardware, device, data, database, system, or network. 

  • Violate, attempt to violate, or knowingly facilitate the violation of the security, integrity, or availability of the Services or any connected or related computer, software, firmware, hardware, device, data, database, system, or network. 

  • Input any information or data into the Services unless you have obtained all necessary rights, licences, consents, and authorizations to use such information and data with the AI Services and to receive and use the resulting outputs. 

  • Introduce or distribute to the Services or use the Services to introduce or distribute any viruses, trojan horses, backdoors, malware, worms, logic bombs, malicious code, or other software, device, technology, or material that is malicious or technologically harmful. 

  • Circumvent or interfere with features, functionality, filters, or safeguards of the Services that are intended to limit or mitigate violations of Laws or this AUP or other harms resulting from use of the AI Services. 

  • Prompt the AI Services to perform in a way that violates this AUP, any terms and conditions applicable to the relevant Kantar product or service that uses AI Services, or any Law. 

  • Otherwise attempt to interfere with the proper working of the Services. 

You will:  

  • Ensure responsible use of outputs, including:  

    • Treating machine generated outputs of the AI Services ("AI Outputs") with caution and transparency.  

    • Carefully evaluating, reviewing and validating AI Output (e.g. summaries, predictions, recommendations) before using them, especially if they will inform decisions with significant impact.  

    • Maintaining human oversight and judgment of AI Outputs.  

  • Ensure your use of the Services including AI Services aligns with ethical standards and does not result in unfair or harmful outcomes. 

Prohibited Uses  

You may use the Services only for lawful purposes and in accordance with this AUP and any terms and conditions applicable to the relevant Kantar product or service that uses Services. You will not modify, use or distribute the Services, and will not use the Services to submit, upload, or input any data, information or materials, or generate or produce any AI Outputs, as set out below: 

  • Breach of Laws: In any way that violates, or promotes, facilitates, or contributes to violation of, any applicable laws, statutes, regulations and codes from time to time in force (collectively, "Laws").  

  • IP infringement: In any way that you know or should know misappropriates, infringes or is likely to infringe any patent, trademark, trade secret, copyright, or other intellectual property, proprietary right, or other rights of any third party.  

  • Child exploitation and abuse: For exploiting, harming, or attempting to exploit or harm, children in any way, including by but not limited to: distributing or promoting child sexual abuse material; facilitating or promoting trafficking, sextortion, grooming, or abuse of children; exposing children to sexual or other inappropriate content; collecting children's personal information without proper disclosures and consent or when not strictly required to provide the requested service; using children's personal information for secondary purposes without proper disclosures and consent; or impersonating or intending to impersonate a child. 

  • Trafficking, sexual solicitation and sexual exploitation: For engaging in, promoting, or facilitating human trafficking or sexual solicitation, exploitation, or violence or any non-consensual intimate activity whether or not it is sexually explicit, or for any purpose that is sexually explicit, obscene, indecent, or pornographic, including deepfake nudity and pornography. 

  • Deception, disinformation, inauthentic activity: To, or to intend to, deceive, defraud, mislead, misinform, or disinform others, including but not limited to: impersonate any person without consent, and legal right (including by presenting any deepfake as authentic); represent, or otherwise deceive or mislead others to think that AI Outputs are human-generated; or distribute or promote misinformation or disinformation such as by but not limited to defamatory content, fake online reviews, comments or other engagement, or 'spam'. 

  • Hate speech, harassment and violence: To engage in, promote, describe, feature, facilitate, incite, or contribute to harassment, discrimination, violence, terrorism, abuse, bullying, threats, intimidation, or hateful behavior, content, or speech. 

  • Discrimination: In any way that discriminates against, or unlawfully treats differentially or unfavorably, any individual or group on the basis of race or ethical origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data (where used for identification purposes), health data, a persons sex-life or sexual orientation.  

  • Privacy, surveillance and tracking: In any way that compromises or violates the legal rights of any person, including by but not limited to: accessing, collecting, soliciting, processing, disclosing, or sharing personal information in any manner that does not strictly comply with Laws and any disclosures; or conducting unlawful monitoring, tracking, or surveillance of individuals. 

  • Weapons and harmful substances: To develop, use, operate, produce, market, exchange, or distribute weapons, explosives, or any dangerous, illegal, regulated, or controlled substances, products, or materials. 

  • Political interference: To engage in the disruption or interference with any election process or otherwise adversely affect the public interest. 

  • Malware or exploits: In any way that supports unlawful active attacks or malware campaigns that cause technical harms, such as delivering malicious executables, organizing denial of service attacks, or managing command and control servers. 

  • Other prohibited activities:  

    • To deploy techniques that may materially distort an individual or group's behavior by impairing their ability to make an informed decision in a way that causes or is reasonably likely to cause significant harm; 

    • To exploit the vulnerabilities of an individual or group due to their age, disability, or a specific social or economic situation, with the objective, or the effect, of materially distorting their behavior in a manner that causes or is reasonably likely to cause significant harm; 

    • For social scoring systems based on social behavior or known, inferred, or predicted personality characteristics that cause detrimental or unfavorable treatment that is disproportionate or used in a context unrelated to the context in which the data was originally collected; 

    • For risk-assessment systems that assess the risk of an individual to commit a crime or re-offend (except in support of a human assessment based on verifiable facts); 

    • For indiscriminate or untargeted web-scraping for the purposes of creating or enhancing facial recognition databases; 

    • For emotion recognition systems in the workplace or educational institutions (except for medical or safety reasons); 

    • To categorize individuals or groups based on biometric data, or to infer characteristics about them such as race, political opinions, religion, or sexual orientation, or emotional states; 

    • For real-time, remote biometric identification of individuals in publicly accessible spaces for the purpose of law enforcement, or facial recognition purposes. 

Third Party Services

  

The AI Services integrate AI products and services (“Third Party Services”), provided by third parties (“Third Party Providers”), and the AI Services may include output derived from and/or in relation to such Third-Party Services (“Third Party Output”).  

The Third Party Services and Third-Party Output are subject to Third Party Provider policies and may be subject to additional policies and requirements made publicly available by the applicable Third-Party Provider (“Third-Party Policies”).  

This AUP supplements and applies in addition to such Third Party Policies. This means that if you are using AI Services that include Third Party Services, you accept and will comply with the Third Party Policies (as may be updated by the applicable Third Party Provider from time to time). You are solely responsible for monitoring the Third Party Policies for changes and for monitoring for additional Third Party Policies made available by the Third Party Providers. Modifications 

You acknowledge and agree that we have the right, in our sole discretion, to modify this AUP from time to time. You will be notified by us of modifications. You are responsible for reviewing and becoming familiar with any modifications. Your continued use of the AI Services after the effective date of the modifications will be deemed acceptance of the modified terms. 

Breach of this AUP 

We may monitor your use of the Services to evaluate your compliance with this AUP and any terms and conditions applicable to the relevant Kantar product or service that uses Services, and to investigate any suspected or reported violation of the same.  

You will promptly notify us of any known or suspected breaches of this AUP, including any unauthorized use of the AI Services or generation of AI Outputs that may infringe third party rights. 

Without limiting any other remedies Kantar may have any breach of this AUP by you shall be deemed a material breach of the Agreement and Kantar may terminate the Agreement (in whole or in part) by giving you thirty (30) day notice.
